Some states do not allow the exclusion or limitation of incidental or consequential damages. If you are a resident of such a state, the above limitations and exclusions may not apply to you to the extent prohibited by law, and our liability shall be limited to the maximum extent permitted by applicable law.

10.3 Class Action Waiver

YOU AND ROUND TABLE PIZZA EACH AGREE THAT ANY CLAIMS ARISING UNDER THESE TERMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION PROCEEDING. No arbitration or claim under these Terms shall be joined with any other arbitration or claim, and no class arbitration proceedings shall be permitted.

10.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or confidential information pending the outcome of arbitration.

If the class action waiver in Section 10.3 is found to be unenforceable for any reason, then the entirety of the arbitration provision in this Section 10 shall be null and void, and the parties shall resolve disputes in court as described in Section 9.
